Submitted by Randi Richardson Marriage contract between Samuel Neier and Clara A. Frazier received for record November 21, 1876, at 3 PM. This agreement made and entered into by and between Samuel Neier of Owen County in the State of Indiana of the one part and Clara A. Frazier of Owen County and state aforesaid of the other part. Whereas a marriage is intended to be shortly had and solemnized by and between the said Samuel Neier and the said Clara A. Frazier, and upon the contract of said intended marriage, the said Samuel Neier for himself, his heirs, executors and administrators, covenants, promises and agrees to and with the said Clara A. Frazier that if she, the said Clara A. Frazier, shall be living at the time of the decease of him, the said Neier, then and in that case she shall have the absolute title to the following named personal property, to wit: one horse of the value of $50; two cows of the value of fifty dollars, and household and kitchen furniture of the value of one hundred dollars, the said property to be appraised at its true value by three judicious neighbors to be mutually chosen by the said Clara A. Frazier and the heirs, executors or administrators of the estate of him, the said Neier. And he, the said Samuel Neier, further covenants, promises and agrees to and with the said Clara A. Frazier, his now intended wife, that she shall have the right, if living at the time of his decease, to enter upon and occupy the following described tract of land but not to have title, to wit, the northeast quarter of the northeast quarter of Section 6, Township 11, North of Range 4 West containing 40.12 acres, to have and use the said premises as a permanent home during her natural lifetime, to have and use all the proceeds, rents and profits of the aforesaid premises to the maintenance and support of herself and any child or children living at the time of the decease of the said Neier which shall be the product or fruits of the aforesaid intended marriage. And the said Clara A. Frazier on her part covenants, promises and agrees to and with the said Samuel Neier that in view of the marriage intended to be shortly had and solemnized between herself and the said Samuel Neier, that if she shall be living at the time of his decease, she will take the property and privileges herein named, in the manner stated in full, of the real and personal estate of him, the said Neier. That notwithstanding the said intended marriage, she agrees for herself, her heirs, executors and administrators that neither she nor they shall ever intermeddle with or have any right, title, claim or interest either in law or equity in or to any of the real or personal property belonging to the said Samuel Neier at the time of his decease. And the said Clara A. Frazier on her part further covenants, promises and agrees to and with the said Neier, his heirs, executors and administrators, that if she shall and will pay the taxes thereon as the same becomes due, and further that she will not suffer any valuable rail timber on said premises to be destroyed, but she shall have full power and authority to use so much thereof as may be necessary to keep said farm in good repair. And the said Clara A. Frazier on her part also further covenants, promises and agrees for herself, her heirs, and administrators that if the said intended marriage shall take effect as aforesaid, that the said Clara A. Frazier will not claim dower in the estate of him, the said Samuel Neier but will permit and suffer him the said Neier to give, grant, devise and dispose of his real and personal property by will or other writing in such manner as he may thing proper except the personal property herein mentioned.
